Terms of service
These Terms of Service (the “Terms”) govern access to and use of the Mopflow service, operated by BARCELO'NET. By creating an account or using the service, the user acknowledges having read and accepted these Terms without reservation.
1. Definitions
- Service: the Mopflow platform, accessible via mopflow.app, including the website and associated web/mobile applications.
- Provider: BARCELO'NET, the company operating the Service.
- Customer: the company or individual subscribing to the Service.
- User: any individual with an account on Mopflow (manager, employee, administrator).
- Data: all information entered into the Service by the Customer and its Users.
2. Purpose of the service
Mopflow is a Software-as-a-Service (SaaS) platform for scheduling, assigning, and tracking recurring services delivered by field teams (cleaning, security, maintenance, personal-care companies).
The Service includes: an automatic scheduling engine, customer site management, team and time-off management, field validations, capacity forecasting, exports, and related functionality.
3. Account creation
Creating a manager account requires:
- a valid email address,
- a password meeting our security requirements,
- acceptance of these Terms and the Privacy Policy.
The Customer is responsible for the accuracy of the information provided and for keeping their credentials confidential.
4. Subscription and billing
Access to the Service is conditional on subscribing to a paid plan, except for any free trial offered by the Provider.
Pricing, payment terms, and the features included in each plan are described on the Pricing page of mopflow.app.
Payment is monthly or annual depending on the plan. Any started period is due in full. In the event of payment default, the Provider reserves the right to suspend access to the Service after a formal notice has remained without effect.
5. User obligations
The User agrees to:
- use the Service in accordance with its intended purpose and applicable law,
- not impair the proper functioning of the Service (intrusion, scraping, security circumvention),
- not enter unlawful, defamatory data, or data infringing third parties' rights,
- obtain consent from their own employees and clients before importing their data into Mopflow,
- promptly notify the Provider of any suspected security breach affecting their account.
6. Provider obligations
BARCELO'NET undertakes to:
- provide the Service with a target uptime of 99.5% (excluding scheduled maintenance and force majeure),
- implement appropriate technical and organizational measures for data security (TLS encryption, daily backups, restricted access),
- respect the confidentiality of data entered by the Customer,
- inform the Customer of major changes to the Service (new features, pricing changes, security updates).
7. Data ownership
The Customer retains full ownership of the Data they enter into the Service. BARCELO'NET only has access strictly limited to the performance of contractual obligations.
Upon contract termination, the Customer may request a full export of their Data in a structured format (JSON or CSV) and its permanent deletion.
8. Limitation of liability
BARCELO'NET will not be liable for indirect or intangible damages (loss of revenue, loss of reputation, loss of opportunity) resulting from use of the Service.
BARCELO'NET's total liability, all damages combined, is limited to the amounts paid by the Customer over the 12 months preceding the event giving rise to liability.
9. Termination
The Customer may cancel their subscription at any time from their account or by contacting the Provider. Termination takes effect at the end of the current subscription period, with no refund of the current period.
BARCELO'NET may terminate the contract with 30 days' notice in case of material breach by the Customer, after a formal notice has remained without effect.
10. Changes to the Terms
BARCELO'NET reserves the right to amend these Terms to reflect changes to the Service or applicable regulations. Material changes will be notified by email at least 30 days before they take effect.
11. Governing law and jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or performance will, failing amicable resolution, be submitted to the French courts having jurisdiction over BARCELO'NET's registered office.
